孖士打与WILHK发布联合调查，揭示性别不平等现象在香港法律界广泛存在

行业代表呼吁共同努力纠正性别失衡孖士打律师行与Women In Law Hong Kong (WILHK)今日公布一项关于香港法律界性别偏见的联合调查结果。该项调查旨在探讨法律界女性在职场面临的行为模式，包括性别偏见和微歧视：有些日常、细微并通常是非故意的言论和互动，可能在日积月累之下，导致性别不平等。该项调查收集了超过360名目前或曾经在香港法律界工作的女性和男性的反馈，结果显示：香港法律界的女性面临系统性的性别偏见，且这种偏见存在于各个层级，从最高职级一直到刚刚开始法律职业生涯的女性。一半的女性受访者认为，由于性别因素，她们在香港法律界受到对她们不利的区别对待。有23.7%的女性受访者曾被要求改变法律专业或职业道路，这一比例是男性受访者的五倍。此外有38.2%的女性认为，由于性别或需要履行照顾家庭的责任，令她们失去职业发展机会。在一些案例中，有女性受访者表示，由于身为照顾者，她们在工作上的投入程度或能力受到质疑。因此，许多女性选择离开法律行业，导致私人执业和内部法务团队高层性别失衡。调查结果也显示，法律界需要解决其普遍存在的“男生俱乐部”文化问题，指由男性组成并拒绝女性参与的圈子，令男性在晋升和职业发展机会方面比女性更有优势。一些女性受访者还报告说，在许多职场环境中，她们经常被忽视、打扰或贬低。另外，许多女律师表示，她们如果驳斥这种行为，就难免被视为难以相处或不团结。另外，女性的外表或行为继续受到故意刁难，有26.1%的女性受访者表示在接收关于工作服饰的建议时遇到负面经历。除了外表被评头品足外，许多女律师曾经因为被视为过于进取和自信，而被”指点”应该如何表现。令人担忧的是，在职业道路上获得晋升的女性发现，她们遭受的微歧视事件有增无减。有23.0%担任高级职位的女性受访者曾遇到过客户宁愿向资历较浅的男同事提出问题或查询，也不向她们提出。全球范围的大量研究和实例显示，职场性别平等有助于业务发展。本次调查显示，律师事务所和企业内部法务团队至少可以制定正确的政策，从而令机构受益。机构还必须努力确保政策得到实际执行，如果不先培养支持这些政策的文化，此类行动可能只会是象征性的。其他有意义的改变可能包括以多元共融的视角改进当前的人力资源系统和人才管理实务，方法是在雇佣的每个阶段——从人才招聘、绩效管理到继任规划——持续接收关于无意识偏见的教育并掌握相关知识。机构还可以为担任领导职务的员工提供有关包容性的专门指导和培训课程，同时也应建立职场环境关键绩效指标，并通过定期反馈和内部同事参与调查来衡量达标情况。关于Women in Law Hong Kong Women in Law Hong Kong (WILHK)是一个为私人执业律师、企业法律顾问和其他业内专业人士提供以解决方案为本的性别平等方针的组织。WILHK获众多香港领先企业和机构支持，是香港最大型法律网络之一。WILHK拥有超过1,500名不同性别的会员，旨在鼓励多元理念的交流共融和相互协作。
