  • Acting for Financial Institutions Professional Indemnity Insurers arising from claims relating to the sale of Lehman Brothers mini-bonds
  • Acted for a UK insurer in the successful defence of a professional indemnity claim upon its Errors & Omissions Policy, against a major insurance broker
  • Represented Essar Insurance Services Ltd., the claims managers to the solicitors’ professional indemnity insurers, in numerous claims, including acting for two firms of solicitors who acted for vendors in relation to the Laguna Verde project. The plaintiffs’ claims were ultimately stayed due to instigation of our security for costs interlocutory application

  • Represented Hong Kong Towngas and its global insurer in the April 2006 Kowloon gas explosion which injured seven persons and killed two
  • Represented Kowloon Motor Bus Co. (1933) Ltd. in a much-publicised bus accident in 2003, known as the Tuen Mun Highway disaster, resulting in numerous fatalities and personal injuries
  • Helped conduct a defence of claim against an owner of the property in the notorious Tokwawan case where a large canopy of the property collapsed resulting in multiple injuries to victims. Successfully negotiated a settlement with one of the lowest apportionment of liability amongst 15 defendants and 11 third parties
  • Negotiated with an insurer in achieving a favourable settlement on a multimillion-dollar claim by an employee who contracted a unique skin condition allegedly from exposure to welding light and fumes in his capacity as a welder
  • Represented a Lloyd’s Syndicate (UK) with respect to defending a personal injury claim arising out of a small gas explosion incident, resulting in a very favourable outcome for Lloyd’s
  • Defended a number of personal injury claims successfully, including Cheang Kam Ian v. Hong Kong Prime Printing Co. Ltd. (HCPI 143 or 1998) (decision of Suffiad J. on 13 January 2000) on the defence of (novus actus interveniens)
  • Represented a global insurer in respect of defending a claim on its Group Accident Policy and successfully preventing a challenge to the policy wording
  • Acting for a number of Life Insurance companies in respect of policy coverage issues, with respect to statutory trusts related issues
  • Advised life insurer on intended civil action against a former insurance agent suspected of misappropriating life policy premiums. Conducted detailed analysis on the possible courses of action (civil and criminal), including the prospects of success of application for injunction and disclosure orders, resulting in settlements for life insurer and its affected customers
  • Advised life insurer on liability arising from potential breaches of the Code of Practice for the Administration of Insurance Agents committed by its agents and defending disciplinary proceedings instituted by the Insurance Agents Registration Board (“IARB”)
  • Defended life insurer against allegations by competitor of poaching of agents incentivised by “above industry benchmark signing-on fees “, and successfully refuted such claims and averted intended legal proceedings
  • Advised various insurers and strategised on policy indemnity and claims management issues with respect to claims under a number of business interruption policies following the 2003 SARS outbreak
  • Advised a number of insurers on the Aberdeen Albert House cases and the implications on their home insurance policies
