Overview

Jeremy Nunns is a senior associate in the Hong Kong office of JSM's Construction Litigation practice. Jeremy has experience in construction law and provides advice on contentious and non-contentious aspects of construction and engineering projects, acting for employers, main contractors, sub-contractors in arbitration and litigation. He has also provided mid-project advisory work to both contractors and employers on a variety of construction related issues and disputes including claims relating to final account, delay, variations and defects. He has completed various in house assignments/secondments with both a statutory authority and contractor clients.

Experience

  • Advised a statutory authority on a number of disputes with contractors relating to consequences of contractual termination and breaches following non-performance, in addition to advising on how to manage disagreements with other contractors to avoid further escalation.
  • Acted for a contractor in prosecution proceedings relating to a charge of material deviation from approved drawings under the Buildings Ordinance (Cap. 123) arising out of an 8-tower luxury residential development in the New Territories.
  • Advised a semi-governmental organisation supporting start-ups and technology companies in relation to significant delay issues arising from a hotel project, as well as addressing practical completion issues amidst disagreements over variations to the works, leading to detailed correspondence on potential termination of the contractor and payment issues against the backdrop of potential mediation and arbitration proceedings.

  • Acted for a major developer on a flagship luxury residential development in relation to a multi-hearing arbitration dispute relating to workmanship, design, delay and disruption issues.
  • Acted for a listed developer in Hong Kong in relation to appeals against building orders on a compulsory purchase of an industrial building.
  • Advised a major Hong Kong transport body in relation to contractual interpretation of project funding arrangements in respect of the construction of a new station and railway and other major infrastructure projects around Hong Kong.
  • Acted for a major Hong Kong transport body in respect of claims strategy on a rail project and review of delay, disruption, variation, unforeseen ground conditions claims.
  • Represented a leading tertiary education institution in Hong Kong on termination of a contractor under a contract for building and specialist refurbishment works.
  • Advised a major Hong Kong developer with water leakage and other defective works claims at one of their flagship shopping centres.
  • Advised a listed company in Hong Kong in respect of defective building works of a subcontractor.
  • Appeared as sole representative for charter flight and tourism company based in Mainland China before a Hong Kong High Court Master in respect of a case management summons regarding an application for adjournment regarding disclosure requests.
  • Advised a supplier of construction materials on various planning matters and issuing a statutory demand for monies due.
  • Advised a tertiary education institution in Hong Kong on delay and prolongation claims by a contractor.
  • Secondments with a large Hong Kong contractor on a significant government tunnel project and a highway project in Hong Kong, providing mid-project legal and strategic advice, working with claims team on site to develop claims relating to delay and disruption and assisting on settlements on a number of disputed issues.
  • Acted for a major Hong Kong contractor in arbitration proceedings against a sub-contractor regarding a significant railway project involving claims for variations, extension of time, loss and expense and unforeseen ground conditions.
Notable non-contentious experience
  • Advised a statutory authority on supplemental agreements and joint venture agreements following the provisional liquidation of a contractor.
  • Advised an asset management company on construction project consultancy tenders, including review of various tender documents for engaging consultants on a logistics centre redevelopment project (such as Architectural, AP, Quantity Surveyor, Structural Engineer, Traffic, Landscaping, Sustainability etc).
  • Advised a statutory body on a supplemental agreement for logistics centre development reflecting changed commercial objectives of client.
  • Advised a government body on hospital facilities management agreement, including reviewing, analysing and amending legal and technical documents forming part of the overall tender document.
  • Advised a leading tertiary education institution on a facilities management agreement, including reviewing and carrying out significant amendments to tender documents.
  • Advised a project management company on a project management agreement, including reviewing and negotiating on behalf of a consultant/contractor company on various terms.
  • Advising a materials supplier on construction material supply agreements – reviewing and advising on options available due to a sudden change in supply of materials.
  • Advising a tunnel operator company on latent defects, warranties and limitation period issues for a tunnel maintenance contract in the New Territories.
  • Advised a statutory authority in house on negotiating various commercial agreements relating to global luxury brands, e-platform collaboration agreements with the government, promotional collaboration agreements with a global theme park, art installation/display agreements, market data subscription agreements.
